On December 06, 2011 (ironically the 10th of Muharram al-Haraam, 1433h, Ashura Day!), a panel consisting of two circuit judges and one district judge listened to the appeal argument of the convicted felon Rafic Labboun. The panel included Circuit Judges Diarmuid Fionntain O'Scannlain and Marsha Siegel Berzon and District Judge Robert S. Lasnik. Labboun was represented by Mark Reichel and the Federal Government was represented by U.S. attorney Hartley West.

On Thursday, January 5, 2012 (the 10th of Safar, 1433), the Federal Appeals judges issued ruling, rejecting the legal arguments of Labboun's attorney:
"Because we have failed to find any error, Labboun cannot be entitled to reversal for alleged cumulative error."
